THE CONSEIL GÉNÉRAL DES BOUCHES DU RHÔNE IS CONDEMNED- THE INTELLECTUAL RIGHTS OF THE ARCHITECT HENRI CIRIANI ARE RECOGNISED BY THE T.G.I.


The First Civil Court of Marseilles, on January 17 2013, ruled the extension to the Arles Archeological Museum has been executed without the involvement or agreement of Henri Ciriani and violates the architect's intellectual rights. The Court condemns the Conseil Général des Bouches du Rhône and requires the payment of €30,000 damages to Henri Ciriani and an additional €3000 to cover expenses in accordance with Article 700. However, the Court did not order the Conseil Général to restore the building since this would require destruction of the partly completed extension. On the other hand the evidence presented by the Conseil National de l'Ordre des Architectes on behalf of the profession was recognised by the Court and was awarded €1500 to cover expenses. The Conseil Général was ordered to pay all judicial costs.
